Mr. Fernandez’s practice ranges from coordination business restructuring processes and liquidation of lines of business- to reorganization of subsidiaries and branches, including strategic advice for implementing financial and labor solutions, mergers, etc. Mr. Fernandez’s know-how extends also to legal advice to officers and directors involved in debt restructuring on matters related to corporate governance and fiduciary duty. 

Professional experience: 

As a specialist in corporate restructuring, Mr. Fernández has acted in the most important settlements in Spain, reaching arrangements with his client’s creditors or managing their orderly winding-up. The most recent debtors represented by Mr. Fernández in reorganization proceedings had liabilities amounting to € 600 million. Currently, Mr. Fernández is acting as a “top player” in the most restructuring cases in Spain and advising top investment banks, insurance and motor companies in the major in-court insolvency proceedings on going. Solid experience in cross-border restructuring principles is also worth telling. 

From the litigation point of view, Mr. Fernández has practiced law continuously for the past 20 years, representing Spanish and foreign companies in more than 700 settlements, corporate and commercial, real estate and construction proceedings in court or arbitration. Mr. Fernandez’s practice ranges from providing in the conference room legal and strategic advice to directors, management, investors, or creditors, to leading complex trials and appeals in the courtroom. 

Academic qualifications: Law degree from University Complutense (Madrid); International commercial law doctorate studies. 

Teaching experience: Lecturer of International Private Law and Commercial Law at Madrid Complutense University (1983); Mentor for Spanish Judges, under a diploma from the General Council of the Spanish Judiciary (2005); Lecturer of “Curso Especial de Derecho Concursal” at Madrid Bar Association (2005, 2006); Lecturer of “Curso de Especialización en Derecho Concursal” (2006), at Comillas-ICADE University; Lecturer of “Máster de Derecho Empresarial” at Madrid University (2007).
